Subscription Terms for SiamPoints

As of: October 2026

These Subscription Terms govern the subscription under which businesses use the digital platform “SiamPoints”. SiamPoints is operated by First Class Tech Ventures Co., Ltd., 352/951 Moo 12, Nong Prue, Bang Lamung, Chonburi 20150, Thailand (“we”, “us” or “SiamPoints”).

1. Scope and Relationship to the Terms of Use

1.1 These Subscription Terms are the Subscription Terms referred to in section 10 of our Terms of Use. They apply to every business that uses SiamPoints as a merchant and govern the plan, the trial, the term, payment and cancellation of the subscription, the purchase of promotional materials and the benefits offered via associations and partner companies.

1.2 In all other respects, our Terms of Use, our Privacy Policy and our Data Processing Agreement (DPA) apply unchanged, and for Broadcasting our Broadcasting Terms apply in addition. These Subscription Terms do not repeat them; where they refer to them, the wording there applies.

1.3 How the business pays the subscription fees is governed by clause 7 of these Subscription Terms. To the extent that section 4 of the Terms of Use provides otherwise for the subscription fees, these Subscription Terms shall prevail.

1.4 Section 12 (governing law and place of jurisdiction) and section 14 (governing language) of the Terms of Use apply to these Subscription Terms accordingly: the Thai version shall prevail.

1.5 In these Subscription Terms:

(1) establishment means each individual location of a business (for example a restaurant, a hotel or a shop);

(2) owner means the person who holds the business’s access as owner;

(3) staff means the employees of an establishment whom the owner has set up in SiamPoints;

(4) “My subscription” means the section of the owner’s account area in which the subscription of each establishment is shown and managed — with the plan, price, next renewal, payment method and invoices;

(5) term means one paid month or one paid year of the subscription (clause 6).

All days and times in these Subscription Terms refer to Thailand time.

1.6 SiamPoints is not a payment service provider (section 4 of the Terms of Use). With the subscription, the business pays SiamPoints directly for a service of SiamPoints’ own. Payments made by its guests never pass through SiamPoints; they always go directly to the business.

2. Subscription per Establishment and Start

2.1 The subscription applies per establishment. If a business has several establishments, each establishment has its own subscription — with its own plan, its own billing cycle, its own term and its own cancellation.

2.2 The subscription starts on the day on which the establishment’s account becomes active — as a rule upon confirmation of the email address; if SiamPoints makes activation subject to a prior review, upon activation (section 3 of the Terms of Use). Before that, the establishment cannot use SiamPoints, and no costs are incurred.

2.3 If a business registers itself on our website, the subscription of its establishment starts with the free trial (clause 4). If the SiamPoints team takes on a business or an additional establishment, the subscription starts without a trial, with the first paid term on the day on which the account becomes active.

3. Plan

3.1 There is one plan for all industries: Business — 1,980 ฿ Promotion Special Price 990 ฿ per month. The plan does not depend on the industry, on the number of rooms or on the size of the establishment.

The prices for annual payment are set out in clause 6.2.

3.2 A different price applies only as a promotion, as a special price or as a benefit via an association or partner company (clause 14), and only if we have entered it for the establishment; it is then shown in “My subscription”. If such a price changes, the new price applies from the next term, never retroactively; we will inform the owner of the new price by email.

3.3 There is no setup fee. The QR templates for printing yourself are included in the plan; acrylic stands and other promotional materials are not provided free of charge but are available only as a voluntary purchase in the promotional materials shop (clause 13).

3.4 All prices are final prices in Thai baht (฿). As long as SiamPoints is not registered for value added tax, invoices and receipts do not include value added tax. From registration onwards, the statutory value added tax is included in the price: it is calculated out of the price and never added on top; the price stays the same.

3.5 Reservations and the online shop, where available for the establishment’s industry, are included in the plan at no extra cost. SiamPoints charges no fee per guest, per scan, per reservation or per sale and takes no commission. Whatever guests pay the establishment, they pay directly to the establishment, never to SiamPoints. In higher-risk industries, online reservations and online payments are available only once the documents under section 3 of the Terms of Use have been provided.

3.6 Promotion Special: While we offer the Promotion Special and places are still available, a business pays the Promotion Special Price shown on our website instead of the regular price of the Business plan — from its first paid term after the trial. The place is secured with the first payment and counts toward the advertised number of places; once all places are taken, new businesses pay the regular price. The Promotion Special Price applies for as long as the subscription continues without cancellation, and the business never pays more than a new business: if the Promotion Special Price or the regular price falls below its price, the lower price applies from the next term; price increases under clause 12 do not apply to it. If the subscription ends after a cancellation, the Promotion Special Price lapses and the place does not become available again; a new subscription is charged at the regular price. Withdrawing a cancellation before the end date (clause 9.5) and late payment without cancellation do not affect the price.

4. Trial

4.1 Anyone who registers as a business on our website can try SiamPoints free of charge for 7 days. The trial starts on the day on which the account becomes active (day 1) and ends on day 7 at 23:59. Example: account active on 7 October — trial until 13 October, 23:59.

4.2 No costs are incurred during the trial. No payment method needs to be chosen at registration; the owner chooses it later in the account area.

4.3 The trial applies only to the establishment from the registration. Further establishments of the same business, and businesses taken on by the SiamPoints team, start without a trial (clause 2.3).

4.4 A trial is available only once — per business and per location. If the email address or the telephone number from the registration has already had a trial, or if an establishment at the same location has already had a trial — including in a suspended, canceled or deleted account —, the subscription starts without a trial, with the first paid term; we will point this out. A different shop with a different name at the same address (for example in a food court or a mall) receives the trial. To check this, we store only non-reversible check values (such as a fingerprint of the details and rounded coordinates of the location).

4.5 Before the trial ends, we remind the owner by email of the end of the trial, of the price and to choose a payment method.

4.6 During the trial, the establishment can use SiamPoints in full with its own QR code and link. It appears in the platform’s public overviews (such as Discover, search, “Near me”, top lists, specials and advertising spaces) only once at least one payment for its subscription has actually been received by us; only then can it also reach out to guests on its own initiative (for example via Broadcasting). Free months via an association or partner company (clause 14) count as a payment for this purpose. If a payment is reversed or the establishment is suspended for late payment, this lapses again.

5. Automatic Renewal

5.1 During registration, the following notice appears directly above the submit button:

By registering, you start the free 7-day trial. After the 7 days, your subscription automatically renews as a paid subscription on the plan you selected, unless you have clicked “Cancel subscription” in your account area before the period expires. You can cancel your subscription flexibly at any time, effective at the end of the current term, with just one click.

5.2 If the owner has not canceled by the end of the trial, the first paid term starts on day 8 at 00:00 — on the plan of the establishment (clause 3) and with the billing cycle chosen at registration (clause 6); the first invoice is due on day 8. Until the end of day 10, the business can pay it without any consequences (grace period); if no payment has been received by then, the establishment is suspended from day 11 (clause 8). If the owner has canceled during the trial, the subscription ends with the trial, at no cost (clause 9.4).

5.3 Each paid term renews automatically for a further term of the same length — one month or one year — unless the subscription was canceled before its end (clause 9).

5.4 If the business pays by card (where offered), the amount for each term is charged to the card automatically until the subscription is canceled. We show the statement on this — the subscription renews automatically and can be canceled at any time with one click, effective at the end of the term — directly next to the button used to start the card subscription; by clicking it, the business gives its consent. We confirm the start by email, including these terms and a link to cancel, and send a reminder 7 days before the first charge after a trial and before every price change.

6. Billing Cycle and Term

6.1 The subscription is paid monthly or annually. The business chooses the billing cycle when registering on our website; monthly is preselected, including for businesses taken on by the SiamPoints team. The owner can later change the billing cycle in “My subscription” or have the team change it; the change applies from the next term.

6.2 With annual payment, the business pays 10 times the monthly price for 12 months: 19,800 ฿ 9,900 ฿ per year.

6.3 The first paid term starts on day 8 after a trial, otherwise on the day on which the account becomes active. Each term starts on a due date and ends on the day before the next due date at 23:59.

6.4 With monthly payment, the due date is the calendar day on which the first paid term started; if a month does not have that day (the 29th, 30th or 31st), it is the last day of that month. With annual payment, the due date is the anniversary; 29 February becomes 28 February in years without that day.

7. Invoices, Payment and Receipts

7.1 Each term is paid in advance; it is due on its due date.

7.2 We send our invoices by email as a PDF to the email address the business has given for invoices — with our PromptPay QR code, which already contains the invoice amount; the owner can also find them in the account area. The first invoice is sent on day 8 after a trial, otherwise on the day on which the account becomes active; each further invoice 5 days before the due date.

7.3 The business pays by PromptPay QR code or by bank transfer to our bank account stated on the invoice — from any Thai account, personal or business. Where offered, it can also pay by credit or debit card or by PromptPay through a licensed payment service provider (Stripe or Opn Payments/Omise). Card details are entered only on the payment page of the payment service provider; SiamPoints never sees or stores them.

7.4 For PromptPay or bank transfer, the business uploads the payment slip directly to the invoice in the account area — on a computer, also via a QR code using a mobile phone, without signing in on the phone. We verify the slip automatically through a service provider (such as SlipOK, EasySlip or Thunder): if the amount, payee and time match and the slip has not been used before, the invoice is deemed paid; otherwise our team checks it. The business can also send the slip via LINE or email.

7.5 For every payment, the business receives a numbered receipt by email; it is also available in the account area. As long as SiamPoints is not registered for value added tax, we do not issue tax invoices. From registration onwards, the business receives a tax invoice/receipt for every payment — with its company details, if it has provided them in its billing details. We document free months (clause 14) with a receipt for ฿0.

7.6 If the business is required under Thai tax law to withhold tax from the subscription fee, it may deduct the statutory amount; with the remaining amount, the invoice is deemed paid in full. The business sends us the withholding tax certificate (50 Tawi); its obligations in this respect are governed by section 5.2 of the Terms of Use.

8. Late Payment and Suspension

8.1 From the due date, the owner’s account area shows the outstanding amount with our PromptPay QR code and our bank details; we also send reminders by email.

8.2 If an amount due has not been paid 28 days after the due date — for the first invoice after a trial, from day 11 (clause 5.2) —, we may suspend the establishment. During this suspension

(1) the owner sees in the account area only the outstanding amount, their invoices, “My subscription” and “Sign out”;

(2) staff cannot use SiamPoints for this establishment;

(3) guests see at this establishment only the notice that SiamPoints is currently not available there — without a reason; offers, promotions and entries in top lists and public overviews of the establishment are not shown;

(4) guests’ points remain unchanged.

8.3 The suspension ends as soon as the payment has been confirmed (clause 7.4).

8.4 The suspension does not end the subscription: the current term continues, the subscription renews under clause 5.3, and the obligation to pay remains. The business can also cancel during the suspension (clause 9).

8.5 Clause 10.3 applies to the retention and deletion of data during a suspension for non-payment. Our rights under sections 6 and 10 of the Terms of Use remain unaffected.

9. Cancellation

9.1 The owner can cancel the subscription at any time with their own access in “My subscription” using the “Cancel subscription” button. Beforehand, we show the owner the consequences of cancellation and the end date; the cancellation is complete only when the owner confirms it once more — with their password or with a code that we send to their email address. If the business has several establishments, the owner chooses for which establishments to cancel.

9.2 The owner can also declare the cancellation to the SiamPoints team — by telephone, via LINE, by email or in writing; the team then records it. Staff cannot cancel.

9.3 We confirm every cancellation to the owner by email, stating the end date.

9.4 The subscription ends

(1) if canceled during the trial, at the end of the trial (day 7, 23:59) — no costs are incurred;

(2) if canceled during the paid subscription, at the end of the current term (last day, 23:59) — with annual payment, therefore, at the end of the paid year.

There is no notice period; it is sufficient to cancel before the end of the current term. Until the end date everything continues as usual; after that we issue no further invoices and make no further card charges. Amounts already due remain payable.

9.5 Until the end date, the owner can withdraw the cancellation with one click in “My subscription” or have the team withdraw it; the subscription then continues as if it had not been canceled.

9.6 After a cancellation, the plan and the billing cycle can no longer be changed.

10. After the End

10.1 From 00:00 on the day after the end date, the establishment is suspended:

(1) The owner can still sign in and sees a limited menu (Subscription, Invoices, My account, Help, Sign out) with the “Reactivate subscription” button; staff can no longer sign in for this establishment.

(2) Guests can no longer collect or redeem points at this establishment; anyone who scans the establishment’s QR code sees that it no longer takes part in SiamPoints.

(3) Offers, promotions and reservations of the establishment are hidden; reservations for the period after the end date are canceled, and guests see this in their account.

(4) Guests’ points remain stored in their accounts.

10.2 Until the end date, the owner can download the establishment’s data in “My subscription” — including points transactions, reservations and guest feedback.

10.3 After the subscription has ended — and likewise during a suspension for non-payment, including after a trial without payment — we retain all data of the establishment, including all media (such as logos, photos, product photos, menus, flyers and videos), for six months. If the owner reactivates the subscription or pays the outstanding amount within this period, everything is immediately available again. We send reminders by email 30 days and 7 days before deletion. After that, we irrevocably delete the establishment’s data and media; the account itself remains. This also applies to guest data that we process on behalf of the business; if the business requests its deletion or return earlier, clause 3.5 of the Data Processing Agreement (DPA) applies. Data that we are required by law to retain — such as invoices, receipts, payment slips and withholding tax certificates — we retain in accordance with section 5 of our Privacy Policy; guests’ points are retained.

10.4 The owner can restart a subscription that has ended at any time with “Reactivate subscription” or have the team reopen it. A new subscription then starts from that day — without a trial.

11. No Refunds

11.1 We do not refund amounts paid — including in the event of cancellation. The only exceptions are amounts paid by mistake (for example due to an incorrect booking) or paid twice; beyond that, we may make a refund as a goodwill gesture in individual cases.

11.2 With annual payment, there is no pro-rata refund on cancellation; the subscription continues until the end of the paid year (clause 9.4).

11.3 This also applies if we suspend the establishment under clause 8 or under section 6 or 10 of the Terms of Use, or delete content or the account.

11.4 There is no money-back guarantee.

12. Price Changes and Changes to these Subscription Terms

12.1 We may change the prices for the future. We will announce a price change at least 30 days in advance by email and in “My subscription”.

12.2 The new price applies from the first term that starts after this notice period has expired — with annual payment, therefore, from the next year at the earliest — never retroactively.

12.3 Until then, the business can cancel under clause 9 with effect from the end of the current term; the announcement points this out.

12.4 For other changes to these Subscription Terms, section 11 of the Terms of Use applies.

13. QR Templates, Sponsors and Promotional Materials Shop

13.1 Under “Print & Display”, the business prints the QR templates of its establishment itself. Before each print, it confirms by ticking a box that it prints the template unchanged and also displays any sponsors on the stand. The reason: part of our costs is borne by sponsors — this is the only reason we can keep the monthly prices this low; without sponsors, the prices would have to be higher. The business undertakes not to alter the templates and to print and display the sponsors as well. We log who printed which version and when.

13.2 The business can voluntarily purchase acrylic stands and other promotional materials in the promotional materials shop at the prices stated there. Each order is a separate purchase contract with SiamPoints. Payment is made online (PromptPay QR code, bank transfer or, where offered, card) or in cash on delivery against a receipt. We deliver to the delivery address provided; for each order, the business receives an invoice or receipt.

14. Associations and Partner Companies

14.1 If a business comes to SiamPoints via an association or a partner company — with its code, invitation link or QR code —, its establishment receives the benefit that we have entered for the members or customers of this association or partner company: exactly one — a percentage discount, free months at the start or special subscription prices per month or year —, in each case for the stated duration. The benefit is shown in “My subscription” and as a separate line on every invoice.

14.2 One association or partner company applies per establishment. The owner can also enter the code later in “My subscription”; a new code replaces the previous one. Both take effect from the next billing month.

14.3 The benefit replaces other discounts and promotions. Annual payment remains available; a percentage discount also applies to the annual price.

14.4 The 7-day trial (clause 4) comes before the free months. Free months count as paid terms (clause 4.6); for each free month, the business receives a receipt for ฿0 stating “Free month – association membership/promotion”.

14.5 The benefit ends when its duration expires — we notify the owner by email 14 days in advance —, when we record that the establishment is no longer a member or customer of the association or partner company (“No longer an association member”), or when the cooperation with the association or partner company ends. From the next billing month, the regular prices under clause 3 then apply.

14.6 If we change the benefit, the change applies to existing members from the next billing month; if the subscription becomes more expensive as a result, we announce this in the same way as a price change under clause 12.

14.7 For the settlement of its commission, the association or partner company learns the name of the establishment and the amount of the subscription. The rights and obligations of associations and partner companies are governed by the Terms for Associations & Partner Companies.

End of the Subscription Terms.
